The purchase of products through toursinmalaga.com implies full and unreserved acceptance by the user of the following purchase conditions. These Conditions do not cover the sale of our Products by third parties outside the Website.

1. Information about the products and modification of the offers

Tours in Malaga can modify at any time the conditions or offers published on its website (prices, products, promotions, and other commercial and service conditions). For this reason, Tours in Malaga recommends that travelers read carefully each time they access the web. But the modifications will not affect in any case the purchases already made by our users. Product and manufacturer names and brands are used for identification purposes only. All photos, descriptions and prices are not contractual. Special offers, promotions or discounts will be valid until the indicated date or until the end of the indicated number of stocks. As well as the prices indicated at the time of consulting the website.

These terms of use will be in a visible place, freely accessible for any consultation. In any case, the acceptance of the terms of use will be an essential prerequisite for the purchase of any experience available through the website.

2. How can I buy on the web?

The purchase of our products by the user is made and perfected by following the purchase procedure described in this section. By purchasing our products, you agree that communications with Tours in Malaga are primarily by electronic means.

To make a purchase, you must add the products that interest you in your “shopping cart”. Once you have filled your cart with all the products to close the purchase with Tours in Malaga you have to proceed to the payment of the amount of the products purchased with your debit or credit card through the payment gateway. The reservation will be confirmed when the user receives the confirmation of his reservation by email, which will reflect in detail the products he has purchased and the present conditions.

For groups, please ask us to send you the budget. The reservation will be confirmed once the payment is made (via bank transfer).

3. Price of the products. Taxes

The price that is indicated at all times next to our products includes VAT. If there is a typographical error in any of the prices shown and if a user has made a purchase decision based on said error, we will notify them of this incident immediately and the user will have the right to cancel their purchase at no cost on their part. The price of the product does not include shipping or transport costs that will be indicated at the time of placing the order.

Prices are usually shown per person. Prices, schedules, dates and routes can be modified if the circumstances require it.

The provision of services when the operation is carried out in the European Community, but outside of Spain, is considered a non-taxable transaction, as established in Directive 2008/8 / EC of February 12, 2008

4. Payment method

Products can be paid through a payment gateway with your debit / credit card or via Paypal.

5. How are the tickets?

The user accepts that the tickets for the purchases of the products are issued electronically and sent by e-mail. You can request a copy of the paper invoice by sending an email to accounting@toursinmalaga.com

6. Taking into account the specialty of the Service

Pets cannot attend unless the specific activity indicates otherwise.

7. Other terms and conditions to take into account
For group walking tours in Ronda, Marbella, Malaga and Mijas a minimum of 4 participants is compulsory to carry out the tour. If the total amount of participants is less than 4, the tour may be cancelled, something that happens less than 10% of our tours.

Minor must be acompanied by their parents.
Children & younger less than 3 years old are complimentary for group walking tours (except the Alhambra and the Caminito del Rey). Please check children discount for trips.
Caminito del Rey requires an age of minimum 8 years old.
The deadline to make a reservation is 1 days prior to the chosen tour, excepting Alhambra tour or trip. 

If weather or force majeure issues make it impossible to do the tour/trip, the hiking trail or the workshop scheduled, a similar alternative will be offered or will be posponed.

Tourists accept the publication of photographs taken during excursions, activities and workshops any in the website www.toursinmalaga.com as well as other online and offline advertising platforms (social networks, agencies, tour operators, etc). Only if the tourist expressly states with a written notice, indicating his desire not to publish his image in any medium, will force TURILANG SL not to make use of these images.
Any links to other websites that appear on the website www.toursinmalaga.com are ofered for information purposes and Tours in Malaga are not responsible for such products, services or content supplied in the pages located in another domain.

Free Hotel pickup and drop-off included from Costa del Sol for private and regular tours that includes transportation..
On board tour guide for groups from 9 persons/ hiking instructor for hiking routes.
Local guide in different destinations.
Some tickets are included. Please have a look at every tour/trip to check inclusions.

10. Know before you go  
Gratuity is not included and is left to individual discretion
Tour bookings are time specific. It is the customer’s responsibility to arrive on time on the date.
Check-in is 10 minutes prior to the booked tour start time. If you arrive late to join your tour, you may not be able to participate and all payments may be forfeited.

11. Cancellation Policy

If the client wants to cancel the tour or excursion, Client must notify us at least 3 days in advance regarding the date of the tour in order to obtain 100% of the money paid (except for tours and excursions where tickets have been paid in which case the tickets are not refundable under any circumstances).

If the client notifies his/her desire not to participate in the tour or excursion with less than 3 days from the date of the tour, the amount will not be returned under any circumstances.

Exceptions:

A) When visiting Caminito del Rey, Nerja, Córdoba and Seville, a 25% penalty rate applies if the client cancels the tour or excursion between 15 days and 3 days before the tour date and the penalty rate It is 100% if the client cancels with 3 days or less with respect to the date of the tour.

B) In the visit to the Alhambra, € 20 per person will be charged for any cancellation between 365 and 31 days before the tour date; A 25% penalty fee will be applied if the client cancels between 30 and 7 days before the tour date .; and a 100% penalty rate will be applied if the client cancels 7 days or less with respect to the tour date.

Outdoor activities are subject to cancellation due to bad weather. If it happens, we will notify you 24 hours in advance. Exception: The Caminito del Rey is carried out outdoors, but its cancellation in advance is not possible, since the management company of the Caminito del Rey does not close the walkway in advance based on the weather forecast, but does so on site based on in safety criteria.

Prices, times, dates and routes in the programme can be modified if circumstances warrant, in which case the client may choose to accept the changes or request a refund of the amount paid prior the start of the service.VAT
The abandonment or separation from the group during the tour, involves the loss of any right to claim total or partial compensation.
Should we need to cancel due to poor weather conditions or other unforeseen circumstances the following applies: We reschedule the tour date and you will be able to accept or decline it. If you don’t accept it, the company will refund the money paid in full.

13. Complaints and Claims

Tours in Malaga has complaint and claim sheets available to consumers or users who request them in accordance with the model established in Decree 82/2022 of May 20 on the new regulation of complaint sheets in Andalusia.
If you wish to make a complaint, please send us an email to accounting@toursinmalaga.com with the concept of complaint. You will receive a response within a maximum period of 5 business days.
If you wish to make a claim, please send us an email to accounting@toursinmalaga.com with the claim concept and we will respond within 10 business days with the claim form in pdf. However, you can also obtain the claim form through the website www.consumresponde.es. We are a company adhered to the Sheet System, so it is possible to present your claim electronically through consumoresponde.es

14. Applicable law and competent courts

The contracts for the purchase of Products through our Website and the controversies or demands that derive from them or that refer to their object or celebration (including litigation or extra-contractual demands) will be governed by Spanish legislation. To resolve any controversy or dispute arising from these terms and conditions, the parties submit to the jurisdiction of the courts of the city of Marbella, unless the law imposes another jurisdiction.

If you are contracting as a consumer, nothing in this clause will affect your rights as recognized by current legislation, and you may choose to file a claim to enforce your rights.

15. Intellectual Property

The trade name and logo are protected by law 17/2001 of December 7. All illustrations and content on the website are protected by copyright. No act of downloading, copying or reproduction of any web page will transfer ownership rights. It gives you permission to view, print and reproduce any material on the website for your personal use and not for commercial purposes. Any misuse can be prosecuted.

16. Nullity

If any provision of these terms of use is considered invalid, the remaining provisions will continue in force, taking into account the will of the parties and the purpose of the Terms and Conditions.
